Xuzhou Updates Land Requisition Compensation Standards for Collective Land
Xuzhou has published revised per-mu compensation standards for requisitioned collective agricultural land, effective through the end of 2028, with district-specific rates and rules on treatment of construction land, unused land, crops and attached structures.
Xuzhou Publishes Revised Land Requisition Compensation Standards
The Xuzhou Municipal People's Government has issued a notice setting adjusted comprehensive land requisition price standards for the city, following provincial approval. The notice applies to all counties, districts, the Xuzhou Economic and Technological Development Zone, the Xuzhou High-Tech Industrial Development Zone and the Xuzhou Huaihai International Land Port Management Committee, as well as municipal departments and units. It was issued to implement the Land Administration Law, its implementing regulations, the Jiangsu provincial land regulation and provincial minimum standard rules.
For foreign founders whose projects involve land use, site selection or dealings with local collective land, the notice is useful background on how compensation is calculated when farmland is requisitioned. It does not change the rules on obtaining land-use rights, but it affects the cost and process of land acquisition by local authorities.
What the comprehensive price covers
The comprehensive price for requisitioning collective agricultural land consists of two parts: land compensation and resettlement subsidies. It does not include social security contributions for affected farmers, nor compensation for attachments on the land or standing crops. Those items are handled separately.
Land compensation figures below refer to dry farmland. Where paddy fields or vegetable plots are requisitioned, the per-mu amount rises by 3,000 yuan and 14,000 yuan respectively.
Rates by district
- Gulou, Yunlong, Quanshan districts and the Xuzhou Economic and Technological Development Zone: each district is treated as a single zone, with a comprehensive price of 54,000 yuan per mu, of which land compensation is 28,000 yuan per mu and resettlement subsidy is 26,000 yuan per person.
- Tongshan district: a single zone with a comprehensive price of 53,000 yuan per mu, comprising 27,000 yuan per mu land compensation and 26,000 yuan per person resettlement subsidy.
- Fengxian, Peixian, Suining, Pizhou, Xinyi and Jiawang: each is a single zone with a comprehensive price of 48,500 yuan per mu, comprising 26,000 yuan per mu land compensation and 22,500 yuan per person resettlement subsidy.
Construction land, unused land and commercial collective land
Requisition of collective construction land follows the comprehensive price for collective agricultural land in the same zone. Requisition of collective unused land follows 0.7 times that standard. For collective operating construction land lawfully obtained, compensation is set through parcel-level land valuation, in line with the principle of equal rights for equal land.
For large and medium-sized water conservancy and hydropower projects, compensation generally follows municipal standards, but if State Council or Jiangsu provincial standards are higher, those higher standards apply.
Social security and payment obligations
Collection, management and use of social security funds for affected farmers follow provincial measures (Su Zheng Fa [2021] No. 87) and the municipal implementation opinion (Xu Zheng Gui [2022] No. 4).
Local governments are required to strictly follow the scope, procedures and compensation standards set by the Land Administration Law, pay land compensation, resettlement subsidies, compensation for rural homes, attachments and crops promptly and in full, and arrange social security funds. They must also manage the transition between old and new standards and address legal risks. After approval and implementation, any surplus in compensation and resettlement funds goes into the county or district land requisition adjustment fund account; any shortfall is topped up by the local government through that account.
Effective date and transitional arrangements
The notice takes effect on publication and remains valid until 31 December 2028. For land requisitions approved by the State Council or Jiangsu provincial government between 1 January 2026 and the effective date, the difference must be paid promptly according to the newly published standards.
Crop and attachment compensation
Compensation standards for standing crops and attachments are set out in an annex. The source text includes detailed rates for trees, nurseries, wells, greenhouses, toilets and plastic sheds. For crops, the source states that crops that can be harvested as scheduled are not compensated; compensation for crops on other agricultural land is calculated by reference to nearby cultivated land; and there is no crop compensation for construction land or unused land.
For foreign founders, the practical takeaway is that land-related costs in Xuzhou vary by district and by land type, and that compensation for attachments and crops is assessed separately from the headline per-mu figures. Any project involving requisitioned collective land should be reviewed with local counsel against the annex and the applicable social security rules.
